1. The Promoter and These Terms

1.1 The Refer-A-Cousin promotion (Promotion) is promoted by EJ Franchising Pty Ltd (ABN 38 692 285 984) of suite 3.01 5 Murray Rose Ave, Sydney Olympic Park NSW (El Jannah, we, us, our).

1.2 By requesting or sharing a Referral Code, or by joining the Legendary Rewards Program using a Referral Code, you accept these terms and conditions (Terms).

1.3 These Terms apply in addition to the Legendary Rewards Program Terms and Conditions, the El Jannah Website Terms of Use, the El Jannah Privacy Policy, and any terms shown on each Coupon (Coupon Terms).

1.4 If there is any inconsistency between those documents:

• (a) these Terms prevail in respect of how the Promotion operates and how a Reward is earned;
• (b) the Coupon Terms prevail in respect of how a Coupon is redeemed; and
• (c) otherwise, the Legendary Rewards Program Terms and Conditions prevail.

2. Definitions

In these Terms:

Coupon means a discount voucher issued to you as a Reward, redeemable in accordance with clause 7.

El Jannah Rewards App or App means the El Jannah app available for download on the Apple App Store or Google Play.

Legendary Rewards Program means the El Jannah Legendary Rewards customer loyalty program, subject to the terms and conditions available at https://eljannah.com.au/legendary-rewards-terms/, as amended from time to time.

Participating Restaurant means an El Jannah restaurant

Promotion Page means https://eljannah.com.au/rewards/refer-a-cousin/, where the current Reward and these Terms are published.

Promotion Period has the meaning given under clause 3.1.

Referee means a person who joins the Legendary Rewards Program using a Referral Code.

Referral Code means the unique referral QR code or link issued to a Referrer under clause 5.1.

Referrer means a Legendary Rewards Program member who is issued a Referral Code.

Reward means the reward described on the Promotion Page at the time the relevant Referee is Verified. As at the date of these Terms, the Reward is a $10 El Jannah Coupon for each of the Referrer and the Referee.

Verified means the Referee has confirmed their email address and mobile number using the one-time code sent by El Jannah, and has otherwise satisfied El Jannah’s account verification checks, within 14 days of creating their account.

3. Promotion Period

3.1 The Promotion opens on 25 November 2025 and continues until it is ended in accordance with clause 11 (Promotion Period).

3.2 If the Promotion is varied, suspended or ended, any Coupon already issued to you remains valid until the expiry date and time shown on that Coupon.

4. Eligibility

4.1 To participate as a Referrer, you must be aged 15 years or over (and obtain your parent/guardian’s consent if under 18 years of age), reside in Australia, and hold a current Legendary Rewards Program account in your own name.

4.2 To participate as a Referee, you must:

• (a) be aged 15 years or over and reside in Australia (and obtain your parent/guardian’s consent if under 18 years of age);
• (b) never have held a Legendary Rewards Program account, whether under the same or a different name, email address or mobile number;
• (c) be personally known to the Referrer; and
• (d) have consented to receive the Referral Code from the Referrer.

4.3 The following persons are not eligible to participate as a Referrer or a Referee:

• (a) directors, officers, employees and contractors of El Jannah and its related bodies corporate;
• (b) El Jannah franchisees, and their directors, officers, employees and contractors;
• (c) agencies, suppliers and service providers engaged in connection with the Promotion or the Legendary Rewards Program; and
• (d) immediate family members of a person referred to in paragraphs (a) to (c) who live in the same household as that person.

4.4 You may hold only one Legendary Rewards Program account. You must not refer yourself or create (or arrange for the creation of) an account in another person’s name.

5. How to Participate

5.1 To participate, during the Promotion Period, a Referrer may request a Referral Code through the El Jannah Rewards App by providing the email address linked to their Legendary Rewards Program account. El Jannah will make the Referral Code available in the App and will email it to that address.

5.2 A Referrer may then share the Referral Code with another person, provided that person:

• (a) is personally known to the Referrer; and
• (b) has provided express consent to receive the Referral Code.

5.3 The Referrer must share the Referral Code personally, using the Referrer’s own email account, messaging application, device or in person. El Jannah does not send referral messages on a Referrer’s behalf, does not provide any facility for a Referrer to submit another person’s contact details to El Jannah, and does not collect a prospective Referee’s contact details from a Referrer.

5.4 A Referral Code must not be:

• (a) posted on any public website, online forum, coupon, voucher or discount code website, online marketplace, or any social media account, page or group intended for a broad or anonymous audience;
• (b) distributed by bulk, automated or unsolicited messaging, or shared with any person the Referrer does not personally know or who has not consented to receive it;
• (c) used in, or promoted through, any paid advertising, search engine marketing or paid search listing; or
• (d) sold, offered for sale, bartered or exchanged for anything of value.

6. Earning a Reward

6.1 A Referrer and a Referee each become entitled to a Reward when the Referee:

• (a) creates a Legendary Rewards Program account using that Referrer’s Referral Code; and
• (b) is Verified;

6.2 A Reward is not earned where the Referee’s account is created other than through the Referral Code (for example, where a person signs up first and applies a Referral Code afterwards), unless El Jannah agrees otherwise.

6.3 The Reward that applies is described on the Promotion Page at the time the Referee is Verified.

7. Receiving and Using a Reward

7.1 Where the Reward is a Coupon, it will appear in the Offers section of the El Jannah Rewards App (when the relevant user is logged in) within 5 business days of the Referee being Verified. El Jannah will email the Referrer and the Referee at their provided email address when the Reward is available in the App.

7.2 Each Coupon:

• (a) is redeemable only at a Participating Restaurant;
• (b) may be used for a single transaction only;
• (c) is subject to a minimum spend of $25 in that transaction;
• (d) expires 14 days (336 hours) after it is added to the user’s account, with the expiry date and time shown on the Coupon;
• (e) is personal the redeeming user, is not transferable, and must not be sold, offered for sale or exchanged for anything of value;
• (f) has no cash value and cannot be redeemed for cash or exchanged for another product;
• (g) cannot be used in conjunction with any other offer, discount or voucher unless stated otherwise on the Coupon; and
• (h) is subject to the Coupon Terms listed on the Coupon.

8. Limits

8.1 There is no limit on the number of Referees a Referrer may refer during the Promotion Period. El Jannah may introduce a limit for the future by publishing it on the Promotion Page and giving notice under clause 11.

8.2 A Referee may receive only one Reward in their role as a Referee, regardless of how many Referral Codes are shared with them.

8.3 Only one Reward is payable to a Referrer for each Referee.

9. Fraud, Abuse and Misuse

9.1 El Jannah may verify the identity and eligibility of any Referrer or Referee at any time and may require reasonable supporting evidence.

9.2 Where El Jannah reasonably believes, on reasonable grounds, that a person has engaged in fraud, has created or used multiple or false accounts, has breached clause 4, 5 or 8, or has otherwise misused the Promotion, including by exploiting a technical error or engaging in misconduct, El Jannah may withhold or cancel a Reward, suspend or close a Legendary Rewards Program account, and/or exclude that person from the Promotion.

9.3 Before acting under clause 9.2, or as soon as reasonably practicable afterwards, El Jannah will notify the person of the reason for the action and give them at least 14 days to respond. If, after considering the response, El Jannah is satisfied that the person did not engage in the conduct, El Jannah will reinstate the Reward or account.

10. Availability and Technology

10.1 Participation requires the El Jannah Rewards App and an internet connection. Your carrier’s data charges may apply.

10.2 El Jannah does not guarantee that the App, the Promotion Page or any Referral Code will be available, uninterrupted or error-free at all times.

10.3 El Jannah is not responsible for a Referral Code, notification or email that is not delivered, is delayed or is misdirected as a result of matters outside El Jannah’s reasonable control, including failures of a third party network, internet service provider, device or spam filter.

11. Changes to, and Ending, the Promotion

11.1 El Jannah may vary these Terms, or suspend or end the Promotion, by publishing notice on the Promotion Page. Where a change is materially adverse to participants, El Jannah will also notify Legendary Rewards Program members by email and will give at least 14 days’ notice before the change takes effect.

11.2 A variation, suspension or ending of the Promotion applies prospectively only. It does not affect:

• (a) a Reward already earned under clause 6.1; or
• (b) a Coupon already issued, which remains valid until its stated expiry.

11.3 Clause 11.1 does not apply where El Jannah must act immediately to comply with a law, or to address a security incident or actual or suspected fraud. In that case El Jannah will give notice as soon as reasonably practicable.

12. Liability

12.1 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law, to the extent that it cannot be excluded, restricted or modified. See www.accc.gov.au for more information about those rights.

12.2 Subject to clause 12.1 and to the extent permitted by law, El Jannah’s liability to you in connection with the Promotion is limited, at El Jannah’s election, to resupplying the relevant Reward or paying the cost of resupplying it.

12.3 Subject to clause 12.1 and to the extent permitted by law, El Jannah is not liable for any indirect or consequential loss in connection with the Promotion.

13. Privacy

13.1 El Jannah collects, uses, holds and discloses personal information in connection with the Promotion in accordance with the El Jannah Privacy Policy.

13.2 Personal information collected in connection with the Promotion is used to administer the Promotion and the Legendary Rewards Program, including to issue Referral Codes, verify eligibility, issue and notify you of Rewards, and detect and prevent fraud.

13.3 El Jannah may collect your personal information directly or through its agents or contractors. El Jannah will use your personal information to conduct and manage the Promotion and the award of any Reward or Coupon. El Jannah may disclose your personal information to its related bodies corporate, agents and contractors to assist in conducting this Promotion, communicating with you or storing data. This may include disclosures to organisations outside Australia including in places such as United States of America, Sweden, India, Bahrain, United Arab Emirates, Ireland and Vietnam.

13.4 By entering, you consent to El Jannah keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging provided that where required by the Spam Act 2003 (Cth), El Jannah includes a functional unsubscribe facility in each direct marketing communication it sends you that you may use to opt-out of any further such communications and provided that the functional unsubscribe facility complies with the Spam Regulations 2021 (Cth).

13.5 If you share a Referral Code with another person and they join the Legendary Rewards Program using it, El Jannah will record that they were referred by you. El Jannah will tell you that a referral was successful but will not disclose that person’s personal information to you.

13.6 You must not share a Referral Code with any person who has not consented to receive it.

14. General

14.1 These Terms are governed by the laws of New South Wales. You and El Jannah submit to the non-exclusive jurisdiction of the courts of New South Wales.

14.2 If any part of these Terms is void or unenforceable, that part is severed and the remainder continues to apply.

14.3 Your rights under these Terms are personal to you and may not be assigned or transferred.

14.4 Nothing in these Terms creates a partnership, agency, joint venture or employment relationship between you and El Jannah.
