Understand our privacy policy and how it applies to you.

1. Introduction

1.1. El Jannah Franchise Company Pty Ltd (ACN 607 919 326) ATF El Jannah Franchise Trust (ABN 67 498 019 635) and its related bodies (collectively referred to as “El Jannah”, “we”, “us” or “our”) recognise the importance of protecting the privacy and the rights of individuals in relation to their personal information and are committed to protecting the privacy of personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (as amended from time to time) (“Privacy Laws”).

1.2. This Privacy Policy sets outs El Jannah’s approach to handling personal information and includes information on how we collect, use and disclose your personal information when you:

  • visit our website (https://eljannah.com.au/) (“Website”);
  • use the El Jannah app (“App”);
  • engage with the Legendary Rewards Loyalty Program;
  • place an order via our ordering methods; or
  • otherwise engage with us and provide personal information to us by any other means, including physically or electronically,

(collectively, the “Services”).

1.3. When you use or access any of the Services, the collection, use, and disclosure of your information will be as described in this Privacy Policy.

1.4. We do not control the use or disclosure of personal information held by El Jannah Franchisees. El Jannah Franchisees are responsible for ensuring that your personal information collected by them is handled in accordance with this Privacy Policy and Australian privacy laws.

2. What information we collect

2.1. When used in this Privacy Policy, the terms “personal information” and “sensitive information” have the meaning given to them under the Privacy Laws, and we are referring to information that identifies, relates to, describes or can be associated with you.

2.2. We only collect personal information that is reasonably necessary for our business functions and activities and to supply you with our products and services.

2.3. When you use our Services, the information we collect includes:

  • Basic Contact Details including your full name, date of birth, address, phone number and email address;
  • Account Information including your username, password, security questions, referral codes and preferences to keep your account secure;
  • Order Information including billing and delivery addresses, purchase history, order details, payment confirmations, dietary requirements, and stores you have visited;
  • Customer Support Information which covers any details you choose to share when communicating with our support team;
  • Marketing Preferences so we understand how you wish to receive marketing communications and promotional materials from us;
  • Device and Usage Data including your IP address which helps us understand how people use our Services and improve our offerings; and
  • Business-related information including company name, ABN/ACN, job title, and bank account details (where relevant for business transactions).

2.4. Some features of the Services may require you to directly provide us with certain information about yourself. You may choose not to provide this information, but doing so may prevent you from using or accessing these features.

2.5. We will not collect sensitive information about you (which includes information about your racial or ethnic groups or political or religious beliefs) without your express consent or otherwise in accordance with Privacy Laws.

3. How we collect personal information

3.1. Your personal information may be collected by us in various ways, including, but not limited to, when you:

  • visit the Website;
  • use the App;
  • purchase a product or service, either in store or online;
  • register for the Legendary Rewards Loyalty Program;
  • provide feedback to El Jannah or request us to contact you;
  • apply for employment or a franchise;
  • register for participation in a competition or survey; or
  • register your information on, or interest with, the Website, social media pages, the App, or other platforms managed by us or a third party that has been engaged by us.

3.2. We may also collect anonymous information regarding your interests, preferences, purchasing behaviour and experience with our services, together with any additional information necessary to deliver those services and respond to your enquiries.

4. What happens if we can’t collect your personal information?

4.1. If you decide not to provide certain information to us, we may not be able to provide you with the product or access to the Services.

5. Digital products and services

5.1. In some cases, we may also collect your personal information through the use of cookies. We, or our technology partners may send “cookies” to your computer or devices or use similar technologies to enhance your online experience on the Website and App.

5.2. “Cookies” are a small data file that is stored on your computer or device which allows us to monitor when you visit our Website and App and which pages on our Website and App you visit. We use cookies to personalise your visit to our Website and App, to analyse traffic on our Website and App and to track user trends, patterns and selections for authorised download and for technical reasons connected with your use of our Website and App.

5.3. If you do not wish to receive cookies, you can set your browser so that your computer does not accept them. However, please note that certain areas of our Website and App can only be accessed in conjunction with cookies or similar devices.

5.4. We may also use “web beacons” that monitor your use of our Website and App. Web beacons are small strings of code that provide a method for delivering a graphic image for the purpose of transferring data, such as the IP address of the computer or device that downloaded the page on which the web beacon appears, the URL (Uniform Resource Locator) of the page on which the web beacons appears, the time the page containing the web beacon was viewed, the types of browser that fetched the web beacon and the identification number of any cookie on the computer previously placed by that server. When corresponding with you via HTML capable e-mail, web beacons let us know whether you received and opened our email. By setting your web browser to display HTML emails as text only, you may be able to prevent the use of some web beacons.

5.5. On their own, cookies or web beacons do not contain or reveal any personal information. However, if you choose to provide us with personal information, it can be linked to the anonymous data stored in the cookies and/or web beacons.

6. How we hold personal information

6.1. We may store your personal information in hard copy or electronic form, whether at our own premises, or at facilities operated by our service providers.

7. How we use and disclose information

7.1. We collect your personal information so that we can use it for our functions and activities and provide products and services to you, which include, among other things:

  • Account Management – create and manage your account on the App and/or Website;
  • Loyalty Program – operate and administer the Legendary Rewards Loyalty Program;
  • Order Processing – process, confirm and fulfill your orders made via the App or the Website, processing a refund of an order and verifying your nominated electronic payment method;
  • Customer Service – provide customer service support by responding to feedback, complaints and enquiries, as well as send important service updates and transactional information;
  • Marketing Communications – keep you informed about marketing initiatives, including direct marketing campaigns, promotions, events, new products, store openings, newsletters and updates;
  • Recruitment – process and manage employment;
  • Service and Site Improvement – to recognise the device you use, collect insights on your experience and adapt our Services to better meet your personal requirements;
  • Internal business operations – facilitating our internal business operations, including fulfillment of any legal and regulatory requirements;
  • Promotions – conducting and allowing you to participate in a promotion, competition or promotional activity;
  • Franchising – providing information that you request about our franchises and processing and considering your franchise application and conducting record checks;
  • Research and insights – to conduct product and market research, and to understand your preferences, patterns, interests and behaviours;
  • Product development – for the administrative, planning, product or service development, quality control and research purposes; and
  • Communications – communicating with you, including in relation to offers, promotions, new products and store openings.

7.2. We may also use your personal information for other purposes not listed above which will be made clear to you at the time we collect your personal information, or for such purposes as may be required or permitted by law.

7.3. We may disclose personal information we collect from you to third parties. The types of persons and organisations to whom we may disclose your personal information includes:
(a) our employees, related entities, suppliers, consultants, contractors or agents:
i. for the purposes set out in the section 7.1 above or for other purposes directly related to the purpose for which the personal information is collected; and
ii. to help us provide and market our products to you;
(b) suppliers and other third parties for the purposes of operation of the Website, App and our business, including web hosting service providers, IT systems administrators, electronic payment processors, data entrants, debt collection agents and electronic network administrators;
(c) professional advisors (such as accountants, solicitors, business advisors and consultants); and
(d) other nominated third parties you have consented to.

8. Marketing Communications

8.1. Where you have consented, we and our related entities will use your personal information from time to time to contact you (including via SMS, email, telephone or online) to let you know about news, special offers, products and services that you might be interested in (Marketing Communications).

8.2. You may opt out at any time by following the instructions in the Marketing Communications or otherwise by email to [email protected].

8.3. Please note that if you opt out, we may still send you non-promotional messages such as receipts or information about your account.

9. Disclosing personal information overseas

9.1. We may disclose personal information to our third-party suppliers and service providers located outside of Australia for some of the purposes listed above. This may involve disclosure to countries including, without limitation, United States of America, Sweden, India, Bahrain, Dubai and Ireland.

9.2. Where we share your personal information with such entities, we will do so in compliance with Australian privacy laws and we will take reasonable steps to ensure that the overseas recipients of your personal information do not breach the privacy obligations relating to your personal information.

10. Access to personal information and correction of it

10.1. You may request access to any personal information we hold about you at any time by contacting us. Where we hold information that you are entitled to access, we will try to provide you with suitable means of accessing it (for example by mailing or emailing it to you). We may charge a reasonable administration fee to cover the costs of meeting your request. We will not charge for simply making the request and will not charge for making any corrections to your personal information.

10.2. There may be instances where we cannot grant you access to the personal information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others or if it would result in a breach of confidentiality. If that happens, we will give you written reasons for any refusal.

10.3. If you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may request us to amend it.

10.4. To protect your privacy and security we will take reasonable steps to verify your identity before granting access.

11. Employment applications

11.1. Generally, the type of personal information that we collect about applicants is the information included in your application for employment, for example your name, postal address, telephone number, email address, education details, employment history and other information relating to your work experience.

11.2. In assessing your application, we may also obtain personal information about you from third parties, for example, from your previous employers or nominated referees. We may also collect sensitive information about you such as information about your health (including any disability) or any criminal record you may have, but only if you provide us consent to obtain such information.

11.3. We collect personal information for any one or more of the following purposes:
(a) assessing you for a position with us or one of our related entities; and
(b) storing your information for future employment opportunities (unless you tell us otherwise).

11.4. If you do not provide us with the information we request, we will be unable to do one or more of the above.

11.5. In order to assess you for a current or future position with us, we may disclose your information to:
(a) referees or previous employers;
(b) recruitment agencies or agencies acting on our behalf;
(c) its related entities and El Jannah Franchisees;
(d) Senior Employees or Managers of El Jannah stores in various locations;
(e) Law enforcement agencies to verify whether you have a criminal record;
(f) educational organisations to the extent necessary to verify your qualifications; and/or
(g) other government bodies for the purposes of assessing your working rights in Australia and your driving record.

11.6. We may engage third party contractors to perform services for us which involves handling personal information. Should this occur, we will take reasonable steps to prevent the contractor from using the personal information except for the purpose for which it was supplied.

12. Franchisee Applications

12.1. Generally, the type of personal information that El Jannah collects about franchise applicants is the information included on the Franchise Application Form for example your name, postal address, telephone number, email address, education details, residency status, employment history, financial capacity and other information relating to your qualifications and experience. Should your application be successful, El Jannah will also obtain further information from you such as your bank account details for the purposes of monthly direct debits.

12.2. In considering your application, El Jannah may also obtain personal information about you from third parties, for example, from your previous employers or nominated referees. Subject to your consent, El Jannah may also collect sensitive information about you such as information about any criminal record you may have or your credit rating.

12.3. El Jannah collects personal information for any one or more of the following purposes:
(a) assessing your application to become an El Jannah Franchisee;
(b) assessing whether you are suitable to progress to each stage of El Jannah franchise recruitment process;
(c) storing your information for future franchise opportunities; and
(d) to include the personal information in El Jannah’s disclosure document to the extent required under the Franchising Code of Conduct.

12.4. If you do not provide the information requested, El Jannah will be unable to do one or more of the above.

12.5. El Jannah may disclose your information to:
(a) recipients of our disclosure document (including potential franchisees to the network);
(b) referees or previous employers;
(c) its related entities;
(d) Senior Employees or Managers of El Jannah stores in various locations;
(e) law enforcement agencies to verify whether you have a criminal record;
(f) educational organisations to the extent necessary to verify your qualifications; and/or
(g) other government bodies for the purposes of assessing your working rights in Australia and your driving record.

12.6. We may engage third party contractors to perform services for us which involves handling personal information. Should this occur, we will take reasonable steps to prevent the contractor from using the personal information except for the purpose for which it was supplied.

12.7. Please note that in accordance with the Franchising Code of Conduct, any former franchisee may make a written request to us to not have their personal details disclosed in our disclosure document.

13. Security

13.1. We take reasonable steps to ensure that your personal information is protected from misuse and loss and from unauthorised access, modification or disclosure.

13.2. Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

13.3. How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

14. Links

14.1. Our Website and App may contain links to other sites operated by third parties which may be of interest to you. We make no representations or warranties in relation to the privacy policies of any third party site and we are not responsible for the privacy policies or the content of any third party site. Third party sites are responsible for informing you about their own privacy practices.

15. Updates to this Privacy Policy

15.1. We may modify or update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons.

15.2. We will post the revised Privacy Policy on our Site, update the “Last Updated” date and take any other steps required by Privacy Laws.
