Specific Terms and Conditions for El Jannah Legendary Rewards
1. Introduction
1.1 Welcome to the El Jannah (“El Jannah”) Legendary Rewards (“Program”). These Terms & Conditions form the basis and govern your participation and use of the Program and any associated features. By participating in the Program, you agree to be bound by these terms. They are designed to protect both you, as a member of the program (“Member”), and El Jannah. It is your responsibility to read and understand these Terms and Conditions.
1.2 Note that these Terms and Conditions cover and govern the basis of the Program, but do not govern and cover the full usage of El Jannah products and services. These Terms & Conditions are separate from the full set of El Jannah Terms & Conditions which you must read and accept upon registering.
1.3 These Terms and Conditions are effective as of the date specified above and may be amended by El Jannah from time to time. The current Terms and Conditions are always available on the El Jannah website. You will be provided with the opportunity to review these Terms and Conditions when joining the Program and following any updates.
1.4 By joining the Program you agree to be bound by these Terms and Conditions. Utilising the rewards of the Program deems you to have accepted these Terms and Conditions in their entirety. These Terms and Conditions form the basis of the Program and govern the use and membership of the Program.
2. Definitions
2.1 In these Terms and Conditions unless the context otherwise requires/states:
- “El Jannah” refers to the companies El Jannah, Pty Ltd and any franchise operating under the El Jannah brand and provides El Jannah products/services.
- “Participating restaurants/stores” refers to select El Jannah franchise restaurants/stores that are participating in the Program.
- “Program” means the El Jannah rewards program, also referred to as Legendary Rewards.
- “Member” means an individual who has registered for and is participating in the Program.
- “Stamp(s)” means the measurement earned by Members through qualifying purchases, activities or other designated means, which determine a Member’s eligibility to unlock a Reward or Voucher.
- “Stamp Card” means the digital Stamp Card that displays the accumulated Stamp(s) earned by Members through qualifying purchases, activities or other designated means, which determine a Member’s eligibility to unlock a Reward or Voucher.
- “Reward(s)” means the privileges, benefits, or bonuses that Members receive or can redeem based on the completion of a Stamp Card or other criteria within the Program.
- “Qualifying Activity” specifies the types of engagement or activities that contribute to earning Stamps.
- “Voucher(s)” refers to the digital Voucher issued to Members when they have accumulated sufficient enough Stamps to complete their Digital Stamp Card and which can be applied to a future purchase to receive a discount.
3. Eligibility
3.1 You hereby represent and warrant that you are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these terms and to abide by and comply with these terms.
3.2 You may only use the Service and provide personal information if you are an Australian resident aged 15 years or over. If you are under 18, you need your parent or guardian’s consent.
3.3 By registering for an account and/or using the Program, you are representing and warranting that you accept and will abide at all times to these Terms and Conditions
3.4 El Jannah employees and their subsidiaries are not eligible.
3.5 To register to become a Member and join the Program a person will need to register for an account online via the El Jannah website or app or through in-store kiosk or Point of Sale (POS).
3.6 Membership is limited to one account per individual.
3.7 Members must ensure their app is updated to the latest version to access program features.
4. Stamps and Stamp Cards
4.1 The El Jannah rewards program allows Members to earn Stamps through qualified spend activity at participating El Jannah restaurants/stores providing El Jannah products and services.
4.2 Stamps earned are calculated off of the total ‘cash value’ of items. The ‘Total cash’ component of all transaction is inclusive of GST, and excludes any voucher applied in the transaction or gratuities.
4.3 Members earn one stamp per visit with a minimum spend of $15.
4.4 During specified periods, Stamps can also be earned for participation in limited-time bonus promotions, such as extra Stamps on particular products, or a promotion to complete a survey (excluding where the terms of conditions for that promotion stipulate an exclusion to earn Stamps). Stamp promotions are subject to change and El Jannah reserves the right to modify and remove promotions at their discretion. Stamps earned through promotions or other bonus events may be subject to additional terms and conditions, including requirements, expiration dates and other.
4.5 Stamps cannot be shared or transferred to other individuals.
4.6 Stamps cannot be redeemed for cash.
4.7 Stamps cannot be earned on gift cards or special promotions unless explicitly stated.
4.8 Stamp Cards expires within the specified expiry period after 30 days of no activity from last Stamp.
4.9 A Member may be notified via various communications channels when they are in danger of having their Stamp Card expire.
4.10 Stamp Card limits may apply per Member.
4.11 El Jannah reserves the right to reassign expired Stamp Cards where required and at their discretion.
4.12 Authorised El Jannah staff members will have the ability to issue stamps to members where necessary or appropriate at the discretion of their manager.
4.13 Members will not be able to transfer Stamps to other member accounts.
4.14 El Jannah reserves the right to add or remove Stamps from a member’s account when required such as in instances where refunds have been issued or fraudulent activity is suspected.
4.15 Stamps are issued at the point of payment, receipts or transactions cannot be retroactively credited.
4.16 Group bookings or shared bills qualify for one stamp per eligible transaction, not per individual.
4.17 Catering orders or private events do not qualify for Stamp earn.
5. Vouchers
5.1 For every 5 Stamps accumulated in the digital Stamp Card, a Member will be eligible for a $10 Voucher, which will be automatically issued and the Stamp Card reset. Vouchers are issued in $10 increments and stored within the Member Account.
5.2 Each Voucher must be redeemed manually online (in a logged in state) when ordering through the website or app or physically scanned when ordering through kiosk or POS.
5.3 All Vouchers are subject to a specified minimum spend requirement and validity period, which will be outlined in the terms of the Voucher. Voucher validity will begin at the point of issue.
5.4 Multiple Vouchers cannot be stacked in a single purchase.
5.5 A single Voucher cannot be split across more than one purchase or partially redeemed. Any unused Voucher balance will be forfeited.
5.6 Vouchers cannot be redeemed for the purchase of gift cards, catering services or private events.
5.7 Vouchers may be used with most promotions and sale items, unless otherwise specified i.e., Vouchers apply to the transaction value after other discounts.
5.8 Members will not be able to transfer vouchers to other member accounts.
5.9 A Member may be notified via various communications channels when they are in danger of having their Voucher expire.
5.10 EL Jannah reserves the right to reassign expired Vouchers where required and at their discretion.
5.11 Authorised El Jannah staff members will have the ability to issue vouchers to members where necessary or appropriate at the discretion of their manager.
5.12 El Jannah reserves the right to add or remove Vouchers from a member’s account when required such as in instances where refunds have been issued or fraudulent activity is suspected.
6. Program Enrolment and Accounts
6.1 All new Members are automatically enrolled in Program upon opting-in to the program and accepting the Terms and Conditions.
6.2 Each Member can only have one account in the Program. Accounts are non-transferable.
6.3 El Jannah reserves the right to close duplicate accounts or accounts suspected of fraud or abuse.
7. Privacy and Data Usage
7.1 By participating in the Program, each Member consents to El Jannah’s collection, use, and processing of their personal data in accordance with El Jannah’s Privacy Policy (https://eljannah.com.au/privacy-policy/).
7.2 El Jannah may collect and process Members’ personal data, including but not limited to name, contact information, date of birth, account information, and engagement activity data, for the purposes of administering and operating the Program, as well as for marketing and promotional purposes.
7.3 El Jannah may share Members’ personal data with third-party service providers and affiliates as necessary for the operation and administration of the Program, subject to appropriate data protection and confidentiality measures.
7.4 El Jannah will implement reasonable technical and organizational measures to protect Members’ personal data against unauthorised access, use, or disclosure.
7.5 Members have the right to access, rectify, or delete their personal data held by El Jannah, subject to applicable laws and regulations. Members may exercise these rights by contacting El Jannah customer support.
7.6 For more information on El Jannah’s data protection practices, Members should refer to the company’s Privacy Policy available on the El Jannah website (https://eljannah.com.au/privacy-policy/).
8. Program Changes and Termination
8.1 El Jannah reserves the right to modify, suspend, or terminate the Program or any portion thereof, including adjusting Stamps, Stamp Cards or Vouchers or other benefits, at any time and for any reason, with prior notice to Members.
8.2 El Jannah may revoke a Member’s membership or access to the Program if the Member violates these Terms and Conditions or engages in any fraudulent, abusive, or improper conduct related to the program.
8.3 In the event of a program termination, El Jannah may, at its sole discretion, provide Members with a reasonable period to redeem any Rewards before the termination date.
8.4 El Jannah shall not be liable to any Member or any third party for any modification, suspension, or termination of the Program or any portion thereof.
8.5 El Jannah benefits will not be awarded in relation to any purchases, transactions or non-transactional actions that are reversed, cancelled and/or refunded.
9. Non-Transferability
9.1 Stamps, Stamp Cards, Vouchers and any other program elements are non-transferable between Member accounts or to third parties.
9.1 Any attempt to transfer, sell, or exchange Stamps, Stamp Cards, Vouchers and any other program elements is strictly prohibited and may result in the immediate termination of a Member’s account and forfeiture of all accumulated Rewards.
10. Fraud and Abuse
10.1 Members may not exploit, hack, modify or disobey the Program’s rules to gain unlimited, excessive or unintended Rewards or other advantages.
10.2 The use of tools, software or services that circumvent the Program’s systems, or otherwise provide an unfair advantage is strictly prohibited and is punishable by law.
10.3 El Jannah reserves the right to immediately close the account(s) of any Member suspected of fraud, abuse, or prohibited conduct, and revoke any available benefits.
